PREAMBLE

The website https://mystore.edhec.edu/ (hereinafter the “Website”) is operated on behalf of EDHEC Business School by AFFECTIVE, a limited liability company (SARL) with a share capital of €16,666.67, whose registered office is located at 9 rue des Augustins, 59000 Lille, registered with the Lille Métropole Trade and Companies Register under number 789 725 108, with the intra-community VAT number FR00789725108 (hereinafter referred to as “Affective”).

EDHEC Business School, a non-profit association under the French 1901 law, with headquarters located at 24 avenue Gustave Delory, 59057 Roubaix Cedex 1, registered under number 783 707 060, is the seller and data controller for all data collected on the Website (hereinafter referred to as “EDHEC”).

Affective acts as the technical subcontractor responsible for the management, logistics, hosting, and maintenance of the online store.

ARTICLE 1: Scope and Acceptance of the General Terms and Conditions of Sale

1.1. Scope

These General Terms and Conditions of Sale (hereinafter the “GTCS”) exclusively govern the remote sale process between EDHEC and the Client, from the order to payment, up to delivery. These conditions outline the required steps for placing an order and ensuring order follow-up between the contracting parties.

The contractual relationship is established between the Client and EDHEC; Affective intervenes solely as a technical and logistics service provider.

The Client declares that they:

  • have the legal capacity to enter into this contract,
  • do not purchase products with the intention of reselling them,
  • are not acting as a professional seller.

1.2. Acceptance of the GTCS

Before placing any order, the Client acknowledges having read and accepted these GTCS. The validation of the order by the Client constitutes full, express, and irrevocable acceptance of these conditions.

1.3. Modifications

EDHEC reserves the right to amend the GTCS at any time. The applicable GTCS are those in force on the date the order is validated.

1.4. Access to the Website

The Website is accessible 24/7, except during maintenance operations carried out by Affective. Neither Affective nor EDHEC shall be held liable for access interruptions related to technical operations or force majeure events.

ARTICLE 2: Products

The My Store EDHEC website offers EDHEC Business School-branded merchandise, clothing, accessories, and institutional items (hereinafter the “Products”).

The products offered by EDHEC are those displayed on the website https://mystore.edhec.affective.fr at the time of the Client’s visit, subject to availability.

In addition to the product photographs, the Client is invited to read each product description to understand its characteristics. Essential characteristics (color, description, composition, dimensions) are described as accurately as possible.

ARTICLE 3: Prices

Prices are displayed in euros (€), inclusive of all taxes (VAT included), excluding delivery fees, which remain the responsibility of the Client.

Should new taxes or contributions be created or existing ones modified, the resulting change may be applied to the product prices offered on the Website.

EDHEC reserves the right to modify its prices at any time. Products will be invoiced based on the rates in effect at the time of order placement.

ARTICLE 4: Identification and Access Security

4.1. Account Creation

The Client must create a personal account before placing any order. The information provided must be accurate, complete, and kept up to date.

4.2. Login Credentials

Login credentials are strictly personal and confidential. The Client is solely responsible for their use and must immediately inform Affective (sav@affective.fr) in case of fraudulent use.

ARTICLE 5: Order

Any order constitutes full and irrevocable acceptance of the prices and product descriptions available for sale. By placing an order, the Client acknowledges having read these GTCS. Order validation constitutes acceptance of the GTCS.

At each step, the Client may review the content of their order and access all relevant product information, prices, delivery conditions, payment methods, and their right of withdrawal.

Once the order is confirmed, an automatic confirmation email is sent to the Client, provided the email address is valid. The Client must check the completeness and accuracy of the information provided to EDHEC and Affective.

EDHEC and Affective shall not be held responsible for data entry errors and their consequences (delays or delivery errors). Any additional costs arising from such errors shall be borne by the Client.

Products offered on the Website are subject to availability. If a product becomes unavailable after an order is placed, Affective will inform the Client by email of the total or partial cancellation of their order.

In case of partial cancellation, the remaining products will be shipped at no extra cost and the unavailable items will be refunded or deducted from the order total.

In case of total cancellation, the payment will not be processed or will be fully refunded.

Orders may be placed online 24/7. EDHEC and Affective strive to ensure constant access to the Website but may suspend access without prior notice for maintenance, updates, or technical issues.

Once the order is validated, the Client can track its status via their account. The order can no longer be modified (product, quantity, delivery method, etc.).

ARTICLE 6: Payment

Orders placed on https://mystore.edhec.affective.fr may be paid by credit or debit card. EDHEC accepts the following payment methods:

  • Google Pay
  • Apple Pay
  • PayPal Account

ARTICLE 7: Payment Security

To ensure secure payments, the Website uses the PAYPLUG secure payment service. This service complies with the PCI DSS standard (Payment Card Industry Data Security Standard). Confidential data (card number, expiration date, CVV) is encrypted and transmitted directly to the PAYPLUG server without passing through Affective’s systems. This system prevents fraudulent use of bank cards by authenticating the cardholder.

After order validation, the payment request is transmitted in real time to the secure payment processor, which requests authorization from the card network. Once authenticated, the transaction will be accepted or refused by the Client’s bank.

ARTICLE 8: Shipping Fees, Delivery Conditions, and Delivery Times

The products are delivered according to the delivery method selected by the Client at checkout:

The Client must check the condition of the parcel and the products upon delivery. In case of anomaly (damaged parcel, missing, damaged, or non-compliant product), the Client must notify us without delay, and no later than 48 hours, at: edhec@affective.fr

ARTICLE 9: Right of Withdrawal

In accordance with the law, the Client has a withdrawal period of fourteen days (Article L.212-20-12 of the French Consumer Code) from receipt of the order, without justification or penalty, except for return shipping costs.

Exchanges and refunds are accepted only for unworn, unwashed products with their original tags and packaging. No right of withdrawal applies to customised products, pre-orders, or unsealed items for hygiene reasons.

The Client must return the products within fourteen days of notifying EDHEC of their decision to withdraw. EDHEC will refund all amounts paid (product price) once the products have been received and verified.

ARTICLE 10: Returns and Exchanges

Returned products must be unworn, in their original packaging and, for postal returns, accompanied by the withdrawal form duly completed (or, failing that, a handwritten note stating the order number, product references, and reason for return).

Return shipping fees are the Client’s responsibility, unless the return concerns a non-compliant product.

ARTICLE 11: Personal Data

Data collected via the Website is processed in accordance with Regulation (EU) 2016/679 (GDPR).

ARTICLE 12: Liability

EDHEC’s and its partners’ liability is limited to direct damages only. EDHEC cannot be held liable for indirect damages (data loss, loss of profit, etc.).

EDHEC and Affective cannot be held responsible for inconveniences or damages inherent to the use of the Internet, such as service interruption, external intrusion, computer viruses, or force majeure events.

EDHEC shall not be held liable for any failure to fulfil its contractual obligations due to force majeure, unforeseeable events, or a Client’s own fault preventing EDHEC from fulfilling the remote sales contract.

The above liability limitations do not apply where prohibited by mandatory legal provisions.

ARTICLE 13: Legal Warranties

Products offered on https://mystore.edhec.affective.fr benefit from the legal warranty of conformity provided by Articles L.211-4 et seq. of the French Consumer Code, and the warranty against hidden defects provided by Articles 1641 et seq. of the French Civil Code.

13.1. Legal Warranty of Conformity

Article L.211-4 of the French Consumer Code requires the seller “to deliver goods that conform to the contract and to be liable for conformity defects existing at the time of delivery.” This includes defects resulting from packaging or installation when contractually required.

To be deemed compliant, the product must:

  • be suitable for the use normally expected of similar goods and correspond to the seller’s description;
  • have the qualities the buyer may legitimately expect based on public claims (advertising, labeling);
  • or possess the characteristics agreed upon jointly or be suitable for any special use requested by the buyer and accepted by the seller (Article L.211-5).

Under Article L.211-10, the sale cannot be cancelled if the defect is minor. Actions arising from non-conformity must be initiated within two years from delivery (Article L.211-12).

13.2. Warranty Against Hidden Defects

The seller is liable for hidden defects that render the product unfit for its intended use or significantly reduce its utility (Article 1641). The seller is not liable for apparent defects (Article 1642). Legal action must be brought within two years of discovery of the defect (Article 1648).

ARTICLE 14: Entire Agreement

If any clause of this contract is rendered invalid due to a change in legislation, regulation, or court decision, the validity of the remaining GTCS shall not be affected.

ARTICLE 15: Duration

These conditions apply for the entire duration that EDHEC provides online services.

ARTICLE 16: Governing Law – Disputes

These GTCS are governed by French law.

In case of a dispute arising from these GTCS, the Parties agree to seek an amicable settlement before initiating any legal action. In accordance with the French Consumer Code, Users may access a free mediation service if prior attempts to resolve the dispute directly with EDHEC have failed.

The proposed consumer mediator is “CM2C”. This mediation service may be contacted via:

If no amicable agreement is reached, the dispute shall be submitted to the competent French courts.
